Topic 1: The legal system – division and separation of powers

This learning activity is aligned to the syllabus ‘learn tostatement:

  • Explain the difference between division of power and separation of power.

To better understand the differences between the division and separation of powers, students are required to refer to the Australian constitution with specific attention directed towards Chapters 1, 2, 3 and sections 51 and 52 as a means to better understanding the difference between the division and separation of powers. Additionally, there is a scenario that examines what happens when there is a dispute involving shared concurrent powers between the Commonwealth and the States.

The activity requires students to read reference material and to complete a series of review based questions.

This learning activity is also cross reference with syllabus outcomes as well as aligned to the relevant theme and challenge component.

The activity is well suited as a minor research task.
